Offer and conclusion of contract

Die Darstellung der Produkte im Online-Shop stellt kein rechtlich bindendes Angebot, sondern eine Aufforderung zur Abgabe einer Bestellung dar.

By clicking on the button “Place order” you are making a binding declaration of intent to order the goods listed on the order page. The purchase contract is concluded by us confirming your order immediately after it has been placed by sending a confirmation e-mail to the e-mail address you have provided. This confirmation email contains all data of the order.

The data of your order will be stored with us until it has been processed. Ihnen liegen diese Daten in Form der gesandten E-Mail nach Vertragsschluss vor. In addition, you have the option of saving or printing out the text of the contract when placing the order.

Orders placed on a weekend or public holiday will be processed on the following working day. Working days are Monday to Friday, unless they fall on a public holiday in the Kingdom of Spain.

Data protection

By placing an order, you consent to the storage and use of your personal data from the order form for the purposes of processing the purchase and dispatch of the product you have chosen. Upon written request, we will provide you with a copy of the data we hold about you. Please refer to our privacy policy.

Return charges

When exercising the right of withdrawal, you must bear the costs of reshipment.

Prices and shipping costs

The prices stated on the product pages include the statutory value added tax and other price components.

In addition to the prices stated, we charge shipping costs for delivery. You will be clearly informed of the shipping costs on the product pages, in the shopping basket system and on the order page.

Payment and delivery

The purchase price is payable in advance and is due with your order. The goods will not be dispatched until the purchase price and shipping costs has been paid into our account. Payment can be made by PayPal, credit card or bank transfer.

Retention of title

The goods remain our property until full payment has been received.

Force majeure

To the extent permitted by law, Margarita – Colectivo de Arte, represented by Marcos Gittis, shall not be liable for any delay of any kind in the performance of its obligations under these terms and conditions if such delay is caused by circumstances beyond its reasonable control and Margarita – Colectivo de Arte shall be entitled to a reasonable extension of time in performing its obligations.

Place of jurisdiction

The place of jurisdiction and performance is Mallorca (Balearic Islands), Spain.

Cancellation policy

Right of withdrawal

You may revoke your contractual declaration in writing (e.g. letter, e-mail) within two weeks without stating reasons. However, the period does not begin before receipt of the goods by the recipient. The timely dispatch of the revocation is sufficient to meet the revocation deadline. The revocation is to be sent to:

Cancellation procedure

If you do not like the product or if you have mistakenly ordered a product other than the one you wanted, please let us know within 14 days of receiving the goods. You will be responsible for the return shipping costs if you exercise your right of cancellation. Upon receipt of the returned artwork in pristine condition, we will refund the purchase amount. The risk of damage or loss lies with the customer until the return has arrived at Margarita – Colectivo de Arte. We reserve the right not to refund the purchase amount if the artwork has been damaged or altered in any way.
